Abuja Lawyer Slams N200m Suit on Airtel over Illegal Deductions

Abuja based legal Practitioner  has dragged Airtel Nigeria Limited to the Federal Capital Territory High, Abuja, to  court.

The court has equally awarded  him N200million as general damages, for the breach of his right to privacy, religion, quite enjoyment of the airtime he paid for, while he is asking for the sum of N1million is to be paid as cost litigation.

Airtel Nigeria Limited has been dragged to Court of the federal Capital Territory, Maitama Abuja over what Barr. Ezugwu Emmanuel Anene described as “Illegal and unwarranted deduction of his airtime.”

The case has been adjourned to 11th April, 2016 for hearing before Justice Okeke. Barr. Anene is arguing that Airtel Nigeria limited has made unaccountable deductions of N5 daily in his airtime as service charge for ‘general news news’ without him subscribing to such service. He said this development has breached his quite enjoyment of the airtime he actually paid for.

Barr. Anene also argued that Airtel Nigeria limited engaged in another illegal deduction, as N50 was deducted weekly from his airtime, compelling him to pay for Islamic weekly against his wish.

He told the court that Islamic Weekly services “is not only breach of his fundamental right to freedom of worship but a deliberate plot to  force him to convert to Islam.

He however declared before the court that unsolicited text messages to his airtel line by the Airtel Nigeria Limited without him subscribing to it breached his right to quite enjoyment of his Airtel line.

Barr.Anene  Asked the court to restrain Airtel Nigeria Limited  from further deductions of any “guise be it Islamic Weekly service, caller tunes, general news services or whatever name called”.

In all, Barr  Anene asked the court to award him N200million as general damages for the breach of his right to privacy, religion, quite enjoyment of the airtime he paid for, while he is asking for the sum of N1million is to be paid as cost litigation.
